Ces crit\u00e8res incluent notamment\u00a0: le prix et les aspects qualitatifs, environnementaux ou sociaux.Le crit\u00e8re environnemental est d\u00e9sormais obligatoire dans les march\u00e9s publics depuis la loi du 22 ao\u00fbt 2021. Au moins un crit\u00e8re doit int\u00e9grer les caract\u00e9ristiques environnementales de l\u2019offre (article L. 2152-7). Ce crit\u00e8re, valid\u00e9 par la jurisprudence europ\u00e9enne et fran\u00e7aise, doit rester objectif et pr\u00e9cis, li\u00e9 \u00e0 l&#8217;objet du march\u00e9, et conforme aux principes de non-discrimination et de transparence.Les march\u00e9s publics doivent concilier le respect des principes de concurrence et des crit\u00e8res qualitatifs, y compris environnementaux. Le d\u00e9fi r\u00e9side dans l\u2019\u00e9quilibre entre co\u00fbt, qualit\u00e9 et exigences \u00e9cologiques.\u00a0\u00a0<\/p>\n\n<p><\/p>\n\n<p><b><u>I- Les crit\u00e8res d\u2019attribution des march\u00e9s publics<\/u><\/b>\u00a0<\/p>\n\n<p>Les crit\u00e8res d&#8217;attribution des march\u00e9s publics en France sont d\u00e9finis par plusieurs dispositions du Code de la commande publique et de la jurisprudence. Le march\u00e9 public est attribu\u00e9 au soumissionnaire ayant pr\u00e9sent\u00e9 l&#8217;offre \u00e9conomiquement la plus avantageuse sur la base de crit\u00e8res objectifs, pr\u00e9cis et li\u00e9s \u00e0 l&#8217;objet du march\u00e9 ou \u00e0 ses conditions d&#8217;ex\u00e9cution. Ces crit\u00e8res peuvent inclure le prix ou le co\u00fbt, ainsi que des aspects qualitatifs, environnementaux ou sociaux. <\/p>\n\n<p>Selon l&#8217;article R. 2152-12 du Code de la commande publique et la jurisprudence, les crit\u00e8res d&#8217;attribution doivent faire l&#8217;objet d&#8217;une pond\u00e9ration pour les march\u00e9s pass\u00e9s selon une proc\u00e9dure formalis\u00e9e, ou lorsque la pond\u00e9ration n&#8217;est pas possible pour des raisons objectives, \u00eatre indiqu\u00e9s par ordre d\u00e9croissant d&#8217;importance. La pond\u00e9ration peut \u00eatre exprim\u00e9e sous forme d&#8217;une fourchette avec un \u00e9cart maximum appropri\u00e9. Les crit\u00e8res et les modalit\u00e9s de leur mise en \u0153uvre doivent \u00eatre indiqu\u00e9s dans les documents de la consultation.L&#8217;article R. 2152-11 du m\u00eame code stipule que les crit\u00e8res d&#8217;attribution ainsi que les modalit\u00e9s de leur mise en \u0153uvre doivent \u00eatre indiqu\u00e9s dans les documents de la consultation. <\/p>\n\n<p>De plus, le pouvoir adjudicateur doit informer les candidats de la pond\u00e9ration ou de la hi\u00e9rarchisation des crit\u00e8res et des sous-crit\u00e8res d\u00e8s lors que ceux-ci sont susceptibles d&#8217;exercer une influence sur la pr\u00e9sentation des offres par les candidats.  La jurisprudence rappelle que les crit\u00e8res utilis\u00e9s doivent \u00eatre justifi\u00e9s par l&#8217;objet du march\u00e9 et ne doivent pas \u00eatre d\u00e9pourvus de lien avec celui-ci, sous peine de m\u00e9conna\u00eetre les principes de libre acc\u00e8s \u00e0 la commande publique et de transparence des proc\u00e9dures. <\/p>\n\n<p>Enfin, les crit\u00e8res d&#8217;attribution ne doivent pas conf\u00e9rer une libert\u00e9 de choix illimit\u00e9e \u00e0 l&#8217;acheteur et doivent garantir la possibilit\u00e9 d&#8217;une v\u00e9ritable concurrence. Le respect de la concurrence dans les march\u00e9s publics est encadr\u00e9 par plusieurs principes et dispositions l\u00e9gales en droit fran\u00e7ais. Les principes g\u00e9n\u00e9raux de la commande publique, \u00e9nonc\u00e9s \u00e0 l&#8217;article L. 3 du Code de la commande publique (CCP), sont la libert\u00e9 d&#8217;acc\u00e8s \u00e0 la commande publique, l&#8217;\u00e9galit\u00e9 de traitement des candidats et la transparence des proc\u00e9dures. Ces principes visent \u00e0 garantir une concurrence saine et non fauss\u00e9e lors de la passation des march\u00e9s publics.  Les pratiques anticoncurrentielles, telles que les ententes et les abus de position dominante, sont strictement interdites. L&#8217;article L. 420-1 du Code de commerce et l&#8217;article 101 du Trait\u00e9 sur le fonctionnement de l&#8217;Union europ\u00e9enne (TFUE) interdisent les ententes qui ont pour objet ou pour effet de fausser le libre jeu de la concurrence. De m\u00eame, l&#8217;article L. 420-2 du Code de commerce et l&#8217;article 102 du TFUE visent les abus de position dominante.  En cas de manquement aux obligations de publicit\u00e9 et de mise en concurrence, des recours peuvent \u00eatre engag\u00e9s. Les seuils de proc\u00e9dure adapt\u00e9s pour les march\u00e9s de fournitures, de services et de travaux sont \u00e9galement d\u00e9finis pour garantir une mise en concurrence ad\u00e9quate. Selon l&#8217;article L. 2152-7 du Code de la commande publique, au moins un des crit\u00e8res d&#8217;attribution doit prendre en compte les caract\u00e9ristiques environnementales de l&#8217;offre. Cette disposition a \u00e9t\u00e9 introduite par la loi du 22 ao\u00fbt 2021, qui vise \u00e0 promouvoir une commande publique responsable.  En outre, la jurisprudence de la Cour de justice de l&#8217;Union europ\u00e9enne (CJUE) dans l&#8217;affaire Concordia Bus Finland (CJUE, 17 sept. 2002, aff. C-513\/99) a valid\u00e9 la prise en compte des crit\u00e8res \u00e9cologiques, \u00e0 condition qu&#8217;ils soient li\u00e9s \u00e0 l&#8217;objet du march\u00e9, ne conf\u00e8rent pas une libert\u00e9 inconditionn\u00e9e de choix au pouvoir adjudicateur, soient mentionn\u00e9s dans le cahier des charges ou l&#8217;avis de march\u00e9, et respectent les principes fondamentaux du droit communautaire, notamment le principe de non-discrimination.  <\/p>\n\n<p>Le Conseil d&#8217;\u00c9tat a \u00e9galement soulign\u00e9 que ces nouvelles dispositions ne d\u00e9rogent pas \u00e0 l&#8217;exigence de choisir l&#8217;offre \u00e9conomiquement la plus avantageuse et que les crit\u00e8res d&#8217;attribution doivent rester objectifs, pr\u00e9cis et li\u00e9s \u00e0 l&#8217;objet du march\u00e9 ou \u00e0 ses conditions d&#8217;ex\u00e9cution (CE, 4 f\u00e9vr. 2021, avis, n\u00b0 401933).  Ainsi, le crit\u00e8re vert est int\u00e9gr\u00e9 dans le cadre plus large des crit\u00e8res d&#8217;attribution des march\u00e9s publics, qui peuvent inclure des aspects qualitatifs, environnementaux ou sociaux, en plus du prix ou du co\u00fbt.\u00a0<\/p>\n\n<p>Les difficult\u00e9s li\u00e9es \u00e0 l&#8217;application du crit\u00e8re vert dans les march\u00e9s de travaux, de fournitures ou de services sont multiples et complexes. Premi\u00e8rement, il existe une difficult\u00e9 \u00e0 justifier les crit\u00e8res environnementaux par rapport \u00e0 l&#8217;objet du march\u00e9. Selon l&#8217;article L. 2152-7 et R. 2152-7 du Code de la commande publique, les crit\u00e8res utilis\u00e9s pour l&#8217;attribution d&#8217;un march\u00e9 public doivent \u00eatre en lien direct avec l&#8217;objet du march\u00e9. L&#8217;absence de ce lien peut entra\u00eener des risques contentieux importants, comme illustr\u00e9 par la jurisprudence du Tribunal administratif de Versailles qui a jug\u00e9 que l&#8217;utilisation de crit\u00e8res sans lien avec l&#8217;objet du march\u00e9 m\u00e9conna\u00eet les principes de libre acc\u00e8s \u00e0 la commande publique et de transparence des proc\u00e9dures.  Par ailleurs, la pond\u00e9ration excessive du crit\u00e8re prix au d\u00e9triment de la qualit\u00e9 des prestations, y compris les crit\u00e8res environnementaux, constitue une autre difficult\u00e9. Cette tendance \u00e0 privil\u00e9gier le crit\u00e8re du prix le plus bas est profond\u00e9ment enracin\u00e9e dans les services de la commande publique, notamment au sein des collectivit\u00e9s territoriales, et est exacerb\u00e9e par un contexte financier souvent contraint.
